1. Introduction
Aunimeda and its subsidiaries, affiliates, partners, contractors, and related entities including but not limited to our US-based partners (Ltd, Inc, and sole proprietorship entities in Los Angeles, San Francisco, New York, Miami), international affiliates, and authorized representatives worldwide ("Aunimeda," "we," "us," "our," "Company") provide various services, including but not limited to: aunimeda.com (main platform with user accounts, dashboards, and partner programs), ai.aunimeda.com (proprietary artificial intelligence services), crm.aunimeda.com (customer relationship management platform), docs.aunimeda.com (digital document signing and management), and all associated subdomains, applications, APIs, and integrated third-party services (collectively, "Services" or "Products and Services").
This Refund & Cancellation Policy explains our procedures for cancellations, refunds, and subscription management. This policy is part of and incorporated into our Terms of Service and should be read in conjunction with them.
BY ACCESSING OR USING ANY OF OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS REFUND & CANCELLATION POLICY, OUR TERMS OF SERVICE, AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE WITH ANY PART OF THESE POLICIES, YOU MUST NOT USE OUR SERVICES.
2. Subscription Services
Many of our services operate on a subscription basis, including but not limited to:
- AI Services (ai.aunimeda.com)
- CRM Platform (crm.aunimeda.com)
- Document Management Services (docs.aunimeda.com)
- Premium API Access
- Enterprise Solutions
- Partner Program Memberships
All subscriptions are billed in advance on a recurring basis according to your chosen billing cycle (monthly, quarterly, or annual). By subscribing to our services, you authorize us to charge your payment method on a recurring basis until you cancel your subscription.
3. Cancellation Policy
3.1 How to Cancel
You may cancel your subscription at any time by:
- Logging into your account and navigating to the "Subscription" or "Billing" section
- Contacting our customer support team at support@aunimeda.com
- Calling our customer service at +1 725 230 9170 during business hours (Monday to Friday, 9:00 AM to 5:00 PM PST)
3.2 Cancellation Processing Time
Cancellation requests are typically processed within 1-2 business days. You will receive a confirmation email once your cancellation has been processed.
3.3 Effect of Cancellation
When you cancel your subscription:
- You will continue to have access to the service until the end of your current billing period
- Your subscription will not renew for the next billing period
- No further charges will be made to your payment method for future billing periods
- You will not receive a refund for the current billing period unless otherwise specified in this policy
3.4 Data Retention After Cancellation
After cancellation, your data will be retained according to our Privacy Policy. For most services, data is retained for 30 days after cancellation, after which it may be permanently deleted. Enterprise customers may have different data retention periods as specified in their service agreements.
4. Refund Policy
4.1 No-Refund Policy
ALL SALES ARE FINAL. Due to the nature of our digital services and the immediate access provided upon purchase, all payments made to Aunimeda for any of our services are non-refundable, except where explicitly required by applicable law. By subscribing to or purchasing our services, you acknowledge and agree that you will not be entitled to a refund for any purchase under any circumstances except those explicitly stated in this policy.
4.2 Limited Exceptions
Refunds may be considered, solely at Aunimeda's discretion, under the following limited circumstances:
- Unauthorized Charges: Charges that can be verified as unauthorized or fraudulent
- Service Unavailability: Complete and continuous unavailability of the service for more than 72 consecutive hours, provided that such unavailability is solely attributable to Aunimeda and not to third-party providers, force majeure events, scheduled maintenance, or any actions or omissions by you or any third party
- Material Defect: A material defect in the service that renders it entirely unusable for its intended purpose, which Aunimeda acknowledges in writing and is unable to remedy within 30 days of written notification
IMPORTANT: The above exceptions do not create any right to a refund and all refund decisions remain at the sole and absolute discretion of Aunimeda. Any refund granted under these exceptions may be partial and will be determined based on factors including, but not limited to, the duration of service usage, resources consumed, and administrative costs incurred.
4.3 Explicitly Non-Refundable Items
The following are explicitly non-refundable under any circumstances:
- Any subscription payment after the service has been accessed or used in any way
- Setup fees, implementation costs, and onboarding charges
- Custom development work and customization services
- Data migration, import, or export services
- Training, consulting, or professional services
- Third-party integrations, add-ons, or extensions
- Any service where usage has exceeded 1% of allocated resources or allowances
- Fees for API calls, transactions, or usage-based billing
- Charges for additional users, storage, or other resource expansions
- Any purchase made more than 24 hours prior to a refund request
4.4 Waiver of Right to Dispute
By using our services, you expressly waive any statutory or regulatory right to dispute, reverse, or chargeback any payment made to Aunimeda, except in cases of demonstrable fraud or unauthorized use of your payment method. You agree that any attempt to dispute or reverse charges through your payment provider, bank, credit card company, or financial institution constitutes a material breach of these terms and may result in immediate termination of your account, pursuit of collection of the disputed amount plus associated fees, and legal action.
4.5 Refund Request Procedure
In the rare event that you believe you qualify for one of the limited exceptions outlined in section 4.2, you must:
- Submit a detailed written request to billing@aunimeda.com within 24 hours of the charge
- Include your full account information, transaction details, and comprehensive documentation supporting your claim
- Provide any additional information or documentation that may be requested by our billing department
Note: Submission of a refund request does not guarantee approval. All requests are subject to thorough review and verification. Processing of any approved refund may take up to 30 business days from the date of approval.
5. Service Interruptions and Modifications
5.1 Service Availability
Aunimeda strives to maintain high service availability but does not guarantee uninterrupted or error-free operation of any service. Temporary service interruptions may occur due to maintenance, updates, or factors beyond our control. Such interruptions, regardless of duration, do not constitute a breach of this agreement and do not entitle you to any refund, credit, or compensation.
In the event of extended service unavailability (exceeding 72 consecutive hours) that is solely attributable to Aunimeda, we may, at our sole discretion, offer one of the following remedies:
- Service credits applicable to future billing periods only (non-transferable and with no cash value)
- Extension of the current subscription period
- Other compensation as determined solely by Aunimeda
You acknowledge that these remedies are discretionary, not automatic, and constitute your sole and exclusive remedy for any service unavailability.
5.2 Service Modifications
Aunimeda reserves the right to modify, update, or discontinue any feature, functionality, or aspect of our services at any time without prior notice. Such modifications, even if they reduce functionality or features previously available, do not entitle you to any refund, credit, or compensation. Your continued use of the service following any modification constitutes acceptance of such changes.
5.3 Force Majeure
Aunimeda shall not be liable for any failure or delay in performance, including any service unavailability or degradation, resulting from causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemic, epidemic, war, terrorism, riot, civil unrest, government action, strikes, labor disputes, internet service provider failures or delays, or denial of service attacks. No refund, credit, or compensation will be provided for any service interruption or degradation resulting from force majeure events.
6. Subscription Changes
6.1 Upgrades
You may upgrade your subscription at any time. When upgrading:
- You will be charged the prorated difference between your current plan and the new plan for the remainder of the current billing period
- Your next billing date will remain the same
- You will immediately gain access to the features of the higher-tier plan
6.2 Downgrades
You may downgrade your subscription at any time. When downgrading:
- The change will take effect at the end of your current billing period
- You will continue to have access to your current plan's features until the end of the current billing period
- No refund will be issued for the difference between plans for the current billing period
- Your next bill will reflect the lower price of the downgraded plan
6.3 Changing Billing Frequency
You may change from monthly to annual billing (or vice versa) at the end of your current billing period. When changing to annual billing, you will receive any applicable annual discount. When changing to monthly billing, you will lose any annual discount previously applied.
7. Free Trials and Promotional Offers
7.1 Free Trials
We may offer free trials of our services. By initiating a free trial, you acknowledge and agree to the following terms:
- You must provide valid payment information to start a free trial
- Your payment method will be automatically charged the applicable subscription fee at the end of the trial period unless you cancel before the trial expires
- You are responsible for canceling your trial before it expires if you do not wish to be charged
- No reminder or notice will be sent prior to the end of your trial period
- Once your payment method has been charged following a free trial, no refund will be provided under any circumstances
- Aunimeda reserves the right to modify or terminate free trials at any time without notice
- You may not be eligible for multiple free trials of the same service
7.2 Promotional Offers and Discounts
Any promotional offer or discount is provided at Aunimeda's sole discretion and is subject to the following conditions:
- All promotional offers are non-transferable, non-refundable, and cannot be exchanged for cash or credit
- Promotional offers cannot be combined with other discounts or promotions unless explicitly stated
- Aunimeda reserves the right to modify or withdraw any promotion at any time without notice
- If you cancel a subscription purchased with a promotional discount, you forfeit the discount and any remaining value
- Eligibility for promotions may be limited based on account history, geographic location, or other factors determined by Aunimeda
- Use of promotional offers constitutes acceptance of all terms and conditions associated with the promotion
By using any promotional offer or discount, you explicitly waive any right to a refund, credit, or compensation related to such promotion.
8. Payment Processing and Currency
All payments and refunds are processed in US Dollars (USD). If your payment was made in a different currency, the refund amount may vary due to exchange rate fluctuations and processing fees charged by your payment provider or bank.
Refunds will be processed using the same payment method used for the original purchase. Processing times for refunds vary depending on your payment method:
- Credit/Debit Cards: 5-10 business days
- PayPal: 3-5 business days
- Bank Transfers: 7-14 business days
- Cryptocurrency: 1-3 business days
9. Enterprise Customers
Enterprise customers with custom contracts are subject to the cancellation and refund terms specified in their service agreements, which may differ from this policy. If there is a conflict between this policy and your service agreement, the terms of your service agreement will prevail.
10. Legal Compliance and Jurisdiction
10.1 Governing Law: This Refund & Cancellation Policy shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. For users accessing our Services from the Kyrgyz Republic or other international locations, these Terms shall be governed by the laws of the Kyrgyz Republic to the extent required by applicable law.
10.2 Mandatory Arbitration: ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THIS POLICY OR THE BREACH, TERMINATION, OR VALIDITY THEREOF SHALL BE FINALLY SETTLED BY ARBITRATION. THE ARBITRATION SHALL BE CONDUCTED IN ACCORDANCE WITH THE RULES OF ARBITRATION OF THE AMERICAN ARBITRATION ASSOCIATION (FOR U.S.-BASED MATTERS) OR THE KYRGYZ REPUBLIC ARBITRATION RULES (FOR INTERNATIONAL MATTERS). THE SEAT OF ARBITRATION SHALL BE WILMINGTON, DELAWARE, USA FOR U.S.-BASED MATTERS OR BISHKEK, KYRGYZ REPUBLIC FOR INTERNATIONAL MATTERS. THE LANGUAGE OF ARBITRATION SHALL BE ENGLISH. THE NUMBER OF ARBITRATORS SHALL BE ONE. THE AWARD RENDERED BY THE ARBITRATOR SHALL BE FINAL AND BINDING ON THE PARTIES.
10.3 Class Action Waiver: YOU AND AUNIMEDA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Aunimeda agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
10.4 Severability: If any provision of this Policy is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision.
11. Changes to This Policy
Aunimeda reserves the right, at its sole discretion, to modify or replace this Refund & Cancellation Policy at any time without prior notice. The most current version will be posted on our website with an updated effective date. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised policy. If you do not agree to the new policy, you are no longer authorized to use our Services and must cease all such use immediately.
